Mediation is a court-favored process where parties to a lawsuit try to settle their dispute with the help of a third party, called the Mediator. The Mediator first tries to understand the positions of the parties by meeting with each individually and ascertaining their key interests, as well as the relative strengths and weaknesses of their case. Then, the Mediator engages in a period of "shuttle diplomacy," meeting with each party separately while working on a joint resolution that meets each party's principled interests in a way that is acceptable to the other side. If the case settles, the parties go home with a signed agreement completely resolving the lawsuit. Most cases, such as divorce, custody matters, business disputes, and probate, can be resolved in a day. Even the most complex cases can be resolved in a way that protects both parties, given enough willingness, skill, and creativity.
